Risks of not serving a professional

Buying a property from a private individual, without the assistance of a consultant, can pose some risks, including:

  • Undeclared defects and flaws: Without proper verification conducted by an expert, you may not be aware of any defects or flaws that the seller may not have disclosed. These non-conformities could emerge only after the purchase of the property and incur additional costs for repairs.
  • False sellers: Unfortunately, in recent years, there have been several scams by fake sellers. This type of fraud occurs when an individual pretends to be the owner of a property that does not belong to them and profits from the deposit/payment made by potential buyers without providing anything in return. This risk is nonexistent if you rely on experts.
  • Incomplete or incorrect documentation: The absence of a professional may result in the lack of a thorough review of the legal documentation related to the property. Incorrect documentation could cause legal issues in the future.
  • Property title problems: Without adequate title research conducted by an expert, you may also risk purchasing a property with title problems, such as encumbrances, undeclared mortgages, or other constraints that may limit your property rights.
  • Cadastre or urban planning violations: You may also not be aware of any cadastre or urban planning violations related to the property, such as non-compliance with building standards, the presence of illegal works, or other violations that could lead to penalties or requests for demolition or restoration.
  • Legal disputes with the seller: Without an intermediary guaranteeing the protection of the parties, there is a risk of misunderstandings or misinterpretations that could lead to legal disputes with the seller following the purchase, for example, regarding unclear contractual clauses or unkept promises.

Many potential buyers, not wanting to take on the risks listed above, automatically dismiss the purchase of a property sold by a private individual. Below, we also list the disadvantages and risks incurred by the seller:

  • Incorrect property valuation: Without the help of an expert, the seller may incorrectly evaluate the property, setting a price that is too high or too low, which could delay the sale or result in a financial loss.
  • Difficulty in promotion: Without the marketing resources of a real estate agency, the seller may encounter difficulties in effectively promoting the property.
  • Price and condition negotiations: Without a professional intermediary, the seller may not be able to negotiate prices and sales conditions effectively with buyers.
  • Exposure to scams or fraud: The seller may also be exposed to scams or fraud by dishonest buyers, through unauthorized payments or fraudulent agreements.
  • Lack of support during the process: As already mentioned, the lack of support during the sales process could lead to the loss of a lot of time and energy.
